Welcome to Ordfuel. By accessing or using our platform, you agree to comply with and be bound by the following terms and conditions (“Terms of Service” or “Agreement”). These Terms of Service govern your use of the Ordfuel website, mobile application, and any related services provided by Ordfuel (“Services”).

By using Ordfuel, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, including any future modifications or updates. We reserve the right to change, modify, or revise these Terms at any time, and such changes will be effective upon posting to the site. Your continued use of the platform after such changes will constitute your acceptance of the updated Terms.

2. Use of Our Platform

Ordfuel provides an online ordering platform and marketing automation services to restaurant owners. You agree to use our Services in accordance with applicable laws and regulations. You are responsible for maintaining the confidentiality of your account and password, and for all activities that occur under your account.

  • You must be at least 18 years old to use Ordfuel.

  • You agree not to use the platform for any illegal or unauthorized purposes.

  • You are solely responsible for the accuracy and legality of all content, data, and materials you provide to Ordfuel, including restaurant menu, customer information, and marketing content.

3. Account Registration and Security

To access certain features of our platform, you must create an account with Ordfuel. During the registration process, you will be asked to provide certain personal information such as your name, email address, phone number, and restaurant details. You are responsible for maintaining the accuracy of this information.

You must also maintain the confidentiality of your account information and are responsible for all activities that occur under your account. If you suspect any unauthorized access to your account, you should immediately notify us.

4. Payment and Fees

Ordfuel charges a 10% commission on each order processed through the platform. This commission is automatically deducted from each order’s total before the payment is transferred to your account. You are responsible for ensuring that your payment details are accurate and up to date.

We reserve the right to change our fees at any time with notice to you. Any changes to our fees will take effect after the notice period, which will be provided via email or through the platform.

5. License to Use Ordfuel

Subject to your compliance with these Terms, Ordfuel grants you a limited, non-exclusive, non-transferable, revocable license to use our platform and Services for your restaurant operations. You may not:

  • Copy, modify, or distribute any part of the platform.

  • Reverse engineer, decompile, or disassemble any portion of the platform.

  • Use the platform to infringe upon the intellectual property rights of Ordfuel or others.

6. User Content and Ownership

By submitting content (e.g., restaurant details, customer data, menu items) to Ordfuel, you grant us a license to use, display, and process such content as needed to provide the Services. You retain ownership of your content but grant Ordfuel a worldwide, royalty-free license to use, store, and process this content solely for the purposes of providing the Services.

You are responsible for ensuring that you have the necessary rights to all content you submit and that such content does not infringe upon any third-party rights.

7. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Violating any laws, regulations, or third-party rights.

  • Interfering with or disrupting the platform or servers.

  • Using the platform to transmit viruses, malware, or other harmful software.

  • Engaging in fraudulent activities, including false advertising or impersonation.

  • Collecting or harvesting personal information from users without consent.

8. Termination and Suspension

Ordfuel reserves the right to suspend or terminate your access to the platform at any time if you violate these Terms of Service. In the event of termination, your right to use the Services will immediately cease, and you will no longer be able to access your account.

You may terminate your account by contacting Ordfuel support. However, any fees or charges incurred prior to termination will still apply.

9. Disclaimers and Limitation of Liability

Ordfuel provides the platform and Services “as is” without warranties of any kind, whether express or implied. We do not guarantee the availability, reliability, or performance of the platform, and we disclaim any responsibility for any errors, interruptions, or delays in the Services.

To the fullest extent permitted by law, Ordfuel will not be liable for any indirect, incidental, or consequential damages, including lost profits, arising from your use of the platform or Services.

10. Indemnification

You agree to indemnify and hold Ordfuel, its affiliates, employees, and partners harmless from any claims, liabilities, damages, or expenses arising out of your use of the platform, including any content you submit, any violation of these Terms, or any third-party rights.

11. Privacy and Data Security

Your use of the Ordfuel platform is subject to our Privacy Policy. By using the Services, you consent to the collection, use, and sharing of your personal data as described in the Privacy Policy.

12. Governing Law and Dispute Resolution

These Terms will be governed by the laws of the jurisdiction in which Ordfuel operates, without regard to its conflict of law principles. Any disputes arising out of or related to these Terms or your use of the platform will be resolved through binding arbitration, rather than in court, unless otherwise required by law.
